Terms of Use
These terms govern access to and use of Portfolio Analyser by PKJL Investments. They are drafted to align with Australian legal settings, including unfair contract term protections and Australian Consumer Law carve-outs, but they should still be reviewed by Australian legal counsel before public launch.
Version 2026-04-09. By creating an account, accepting an invitation, or using Portfolio Analyser, you agree to these Terms of Use. If you are using the platform for a business, agency, or client, you confirm that you are authorised to bind that business or use the platform on its behalf.
Portfolio Analyser is an information, screening, workflow, and analysis platform. Unless we expressly agree otherwise in writing, the platform and its outputs do not constitute personal financial advice, credit advice, legal advice, tax advice, accounting advice, or valuation advice.
Any information, screening output, scenario, ranking, metric, growth estimate, serviceability estimate, memo, or report is prepared without taking into account a user's full objectives, financial situation, needs, tax position, legal position, or personal circumstances.
Before acting on any platform output, users should assess appropriateness for their own circumstances and, where needed, obtain independent professional advice.
You use the platform and any outputs at your own risk. You must independently verify critical information, including property details, prices, rents, growth assumptions, serviceability assumptions, legal ownership, lending terms, taxes, fees, and any third-party data used in a decision.
We do not warrant that outputs are complete, current, suitable for a specific decision, or free from estimation error, data gaps, or provider error. Data sources, assumptions, and provenance signals should be read carefully before any reliance.
- personal investor screening and portfolio analysis
- internal business use by authorised Professional agency users for client and workflow management
- reasonable use of reports, exports, and platform content generated for your own lawful use
- scraping, copying, reverse engineering, or systematically extracting data or outputs beyond normal platform use
- using the platform to provide unlawful, misleading, or unauthorised advice or services
- interfering with platform security, authentication, availability, or other users' access
- uploading or entering information you do not have authority to use or disclose
You must keep account credentials secure, ensure information you enter is accurate to the best of your knowledge, and only invite or grant access to users you are entitled to authorise.
You retain responsibility for the lawfulness of data you enter into the platform, including personal, client, portfolio, and workflow data. You grant us a licence to host, process, store, copy, back up, transmit, and display that data as reasonably necessary to operate, secure, support, and improve the platform.
We may use de-identified or aggregated data for analytics, product improvement, estimate refinement, benchmarking, security monitoring, and business reporting. We do not claim ownership of your underlying personal or client data.
We may use third-party and official data providers, maps, email, SMS, hosting, authentication, and infrastructure services. Those services can change, fail, or be withdrawn, and this may affect availability or accuracy.
We may modify, suspend, or discontinue features where reasonably necessary for product, security, legal, provider, or operational reasons.
To the maximum extent permitted by law, PKJL Investments excludes liability for any indirect, incidental, special, consequential, or exemplary loss, and for loss of profit, revenue, business opportunity, goodwill, data, or anticipated savings arising from or in connection with the platform or its outputs.
To the maximum extent permitted by law, our aggregate liability arising from the platform is limited to the amount you paid us for the relevant service in the 12 months before the event giving rise to the claim, or if no amount was paid, a reasonable re-supply of the relevant service.
Nothing in these terms excludes, restricts, or modifies rights, guarantees, or remedies that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law or any other applicable law. Where a law permits us to limit a remedy, our liability is limited to the minimum extent permitted by that law.
We may suspend or terminate access where reasonably necessary for security, fraud, provider, operational, legal, or material breach reasons. You may stop using the platform at any time.
